It is important to know your rights if an officer pulls you over for suspicion of DUI. A DUI is a very serious offense and your actions during an interaction with law enforcement can make a big difference if you are arrested for DUI. First of all, you are not required to answer any questions on the side of the road. You are not required to answer questions by law enforcement and should always respectfully decline all requests for statements. You are however required to provide your driver’s license, registration, and proof of vehicle insurance compliant with Arizona insurance standards. Refusing all roadside tests is always the best choice in these matters. Remember it will be the officer, not you that decides how well you did on these tests and even sober drivers can fail these tests. You should always refuse all roadside tests including the games the officer would like you to do like touching your nose, standing on one leg, walking a line, following a pen with your eyes, etc. You are not required to play any of these roadside games. You and your passengers are required by law to exit the vehicle if an officer asks you to do so. You should always ask to speak to an attorney quickly and often. You should not consent to any searches of your person or vehicle without a warrant. Punishments for DUI offenses include mandatory jail, mandatory fines, counseling, license suspensions, ignition interlock devices, as well as a possible increase in auto-mobile insurance rates. These punishments can be severely increased for multiple DUI convictions. Committing a DUI while driving on a suspended or revoked license for any reason can result in criminal prosecution for a felony offense. A felony conviction can haunt you for the rest of your life. DUI is a serious offense and it can change your life and the lives of others for the worse. The best advice concerning a DUI is to not get one in the first place. But, if you are arrested for DUI, call to schedule an appointment with one of our DUI attorneys to discuss your legal matter.
