If you require access to classified, secret or top secret information for your job, you will have to complete an application for security clearance, which is sent to the federal government by your prospective employer and either approved or denied by the Department of Defense. The Department of Defense will fully investigate your background to determine if you are eligible for security clearance, and will evaluate areas of your life including past conduct, United States loyalty, drug or alcohol abuse, criminal records and financial responsibilities. If you are denied security clearance, you may wish to file an appeal with the Department Of Hearings And Appeals. The DOHA exists to conduct reviews of security clearance applications for those who wish to file an appeal for a security clearance denial. Upon denial of your security clearance, you will receive a Statement of Reasons that details why you were deemed unfit to receive access to classified, secret or top secret information. These reasons could be anything from a past history of criminal conduct to inappropriate sexual behavior. At this time, it is in your best interest to consult with an attorney who can help you prepare a response to the statement of reasons and challenge the department’s decision that you are unfit to receive security clearance. You will provide all documentation to the Department Of Hearings And Appeals before the hearing takes place, so they may review your records in advance.
