According to premises liability law, owners and occupiers of property who allow people to come onto the property are legally responsible for accidents and injuries that may happen on that property. The property owner must make sure that the property is safe for the whole community by maintaining safe conditions and either repairing hazards or putting up appropriate warning signs about the danger if a hazard cannot be repaired immediately.
A property owner can be considered negligent if he/she creates an unsafe condition, such as cleaning floors and leaving them slippery or excavating on the property and leaving the hole accessible. Negligence on the part of the property owner may also result from allowing an unsafe condition to remain after learning of the condition, such as uneven flooring, a water leak onto the floor, or broken stairs.
The types of accidents that may lead to a premises liability claim include a slip and fall on a retail store floor, falling trees or tree branches, being injured on a amusement park ride, drowning in a pool, or the owner failing to provide adequate security.
