New Legislation Would Ban Foreign Family Law in Coral Springs

America was established largely through immigration and nowhere is that more apparent than South Florida. Whether it’s immigration in Coral Springs, Fort Lauderdale or Miami, foreign-born residents make up a large percentage of our population. However, a new bill passed by the Florida Legislature would limit the ability of state courts from recognizing rulings and agreements established by foreign courts pertaining to divorce, alimony, child support and child custody. The bill is currently awaiting the signature of Governor Rick Scott. Should the Governor’s pen propel the bill into law, it will certainly change how the courts handle cases of child custody in Coral Springs. The bill passed by a vote of 78-40 despite protests from some legislators who accused supporters of creating a greater problem rather than a solution. The new law is designed to integrate prior case law into the state’s statutes. Supporters say the new bill would lessen the amount of time a case, determined by foreign law, would take to go through the state court system. Opponents say the law is a gigantic waste of time and would make Florida look like a “xenophobic” state. The original version of the bill was far more rigid and would allow courts only to adhere to U.S. Law no matter what the circumstance. However, in the wake of protests by the Anti-Defamation League, the bill was revised with more flexibility, which lessened the outspoken opposition. However, the Anti-Defamation League remains staunch in its position. The organization maintains the new law would hurt state’s reputation as an international destination. The new law would only apply to family law cases and agreements. Some critics, including Coconut Creek Representative Jim Waldman, say the bill’s origins comes from anti-Muslim sentiment. He claims anti-Islamic activists have been spreading the myth of Muslims using the teachings from the Koran and laws from other Muslim countries. This particular law could affect thousands of people across South Florida.
